บท ๒ ขบวนการย้ายพระสงฆ์เจ้าอาวาส

Can.1748 If the good of souls or the need or advantage of the Church requires that a pastor be transferred from his parish which he is governing usefully to another parish or to another office, the bishop is to propose the transfer to him in writing and persuade him to consent to it for the love of God and of souls.

Can.1749 If the pastor does not intend to yield to the counsel and persuasion of the bishop, he is to explain his reasons in writing.

Can.1750 Notwithstanding the reasons alleged, if the bishop judges that he is not going to change his plans, he is to discuss the reasons which favor or oppose the transfer with the two pastors chosen in accord with can.1742, $1; if he then decides to implement the transfer, he is to repeat the paternal exhortations to the pastor.

Can.1751 $1. When this has been done, if the pastor still refuses and the bishop thinks the transfer must be made, he is to issue a decree of transfer stating that the parish shall be vacant after the lapse of a predetermined time.

$2. If this period of time has passed in vain, he is to declare the parish vacant.

Can.1752 In case of transfer, the prescriptions of can.1747 are to be applied, with due regard for canonical equity and having before one’s eyes the salvation of souls, which is always the supreme law of the Church.

มาตรา ๑๗๔๘ หากเพื่อความดีของวิญญาณ หรือความจำเป็น หรือผลประโยชน์ของพระศาสนจักรเรียกร้องให้ต้องย้ายเจ้าอาวาสจากวัดซึ่งเขาได้ปกครองอย่างเกิดประโยชน์ ไปยังวัดอีกแห่งหนึ่งหรือไปปฏิบัติหน้าที่อื่น พระสังฆราชต้องเสนอการย้ายแก่เขาเป็นลายลักษณ์อักษร และชักชวนให้เห็นด้วย เพื่อความรักของพระเจ้าและของวิญญาณ

มาตรา ๑๗๔๙ หากพระสงฆ์เจ้าอาวาสผู้นั้นไม่ยินยอมทำตามคำแนะนำ และคำชักชวนของพระสังฆราช เขาต้องให้เหตุผลเป็นลายลักษณ์อักษร

มาตรา ๑๗๕๐ แม้ว่าได้ให้เหตุผลอธิบายแล้ว หากพระสังฆราชตัดสินว่ายังคงไม่เปลี่ยนความตั้งใจ ในกรณีนี้ท่านต้องถกเหตุผลที่สนับสนุนหรือขัอแย้งการย้ายกับเจ้าอาวาส ๒ องค์ที่ได้รับเลือกตามกฎเกณฑ์ของมาตรา ๑๗๔๒ วรรค ๑ หากท่านยังตัดสินว่ายังต้องมีการย้าย ท่านต้องย้ำคำเตือนเยี่ยงบิดาต่อเจ้าอาวาสนั้น

มาตรา ๑๗๕๑ วรรค ๑ เมื่อได้ปฏิบัติสิ่งเหล่านี้แล้ว พระสงฆ์เจ้าอาวาสยังคง

ปฏิเสธ และพระสังฆราชยังคิดว่าจำเป็นต้องย้าย ท่านต้องออกคำสั่งย้าย โดยระบุว่าวัดจะต้องว่างลงหลังจากเวลาที่กำหนดไว้สิ้นสุดลง

วรรค ๒ หากเวลากำหนดสิ้นสุดลงโดยไม่เกิดผลอะไร ท่านต้องประกาศให้วัดว่างลง

มาตรา ๑๗๕๒ ในกรณีการย้าย ให้นำข้อกำหนดของมาตรา ๑๗๔๗ มาปรับใช้ โดยคำนึงถึงความชอบธรรมของกฎหมายพระศาสนจักร และโดยคำนึงถึงความรอดของวิญญาณ ซึ่งเสมอไปต้องเป็นกฎหมายสูงสุดของพระศาสนจักร
