Can.1465 $1. Fatalia legis or the time limits set by law for extinguishing the rights to act cannot be extended nor validly shortened unless the parties request it.

$2. Before they have lapsed, however, judicial time limits and agreed upon time limits can be extended by the judge for a just cause after hearing the parties or if they request it; such time limits, however, may never validly be shortened unless the parties agree.$3. But the judge is to see to it that the litigation is not overly prolonged by such extensions.

Can.1466 When the law does not establish time limits for positing of procedural acts, the judge must define them taking into consideration the nature of each act.

Can.1467 If the tribunal is closed on the day scheduled for a judicial act the time limit is extended to the first day following which is not a holiday.

มาตรา ๑๔๖๕ วรรค ๑ ชะตากรรมกฎหมาย (fatalia legis) กล่าวคือ เวลาที่กำหนดไว้โดยกฎหมาย เพื่อทำให้สิทธิตามกฎหมายสิ้นสุดลง และไม่สามารถขยายหรือตัดทอนอย่างถูกต้องตามกฎหมายได้ เว้นแต่คู่คดีร้องขอ

วรรค ๒ อย่างไรก็ตาม ก่อนที่กำหนดเวลาตามกฎหมาย หรือที่ตกลงกันจะสิ้นสุดลง ผู้พิพากษาสามารถขยายกำหนดเวลาใหม่ได้เมื่อมีเหตุอันสมควร หลังจากได้ฟังคู่คดีแล้ว หรือเมื่อคู่คดีขอร้อง อย่างไรก็ดี กำหนดเวลาดังกล่าวต้องไม่สามารถทำให้สั้นลงอย่างถูกต้องตามกฎหมายได้ เว้นแต่คู่คดียินยอม

วรรค ๓ นอกจากนั้น ผู้พิพากษาต้องพิจารณาด้วยว่า คดีจะไม่ยืดเยื้อเกินไป เพราะสาเหตุการขยายเวลาดังกล่าว

มาตรา ๑๔๖๖ กรณีที่กฎหมายไม่ได้กำหนดระยะเวลาการดำเนินคดีผู้พิพากษาต้องกำหนดเอง โดยพิจารณาธรรมชาติของการดำเนินคดีแต่ละขั้นตอน

มาตรา ๑๔๖๗ หากศาลปิดทำการในวันครบกำหนด ให้ขยายเวลาไปยังวันทำการถัดไป ซึ่งไม่ตรงกับวันหยุด
