ภาค ๑  การพิจารณาความ

Can.1400 $1. The object of a trial is:

1.to prosecute or to vindicate the rights of physical or juridic persons, or to declare juridic facts;

2.to impose or declare the penalty for offences.

$2. However, controversies which have arisen from an act of administrative power can be brought only before the superior or an administrative tribunal.

Can.1401 By proper and exclusive right the Church adjudicates:

1.cases concerning spiritual matters or connected with the spiritual;

2.the violation of ecclesiastical laws and all those cases in which there is a question of sin in respect to the determination of culpability and the imposition of ecclesiastical penalties.

Can.1402With due regard for the norms established for the tribunals of the Apostolic See, all the tribunals of the  Church   are   regulated  by   the following canons.

Can.1403$1. The causes of the canonization of the servants of God are regulated by special pontifical law.

$2. The prescriptions of this Code, however, are applicable to the aforementioned causes whenever the pontifical law refers to the universal law or when it is a question of norms which affect those causes from the very nature of the matter.

มาตรา ๑๔๐๐ วรรค ๑ วัตถุประสงค์ของการพิจารณาความ คือ:

๑.เพื่อเรียกร้อง หรือทวงสิทธิของบุคคลธรรมชาติ หรือนิติบุคคล หรือประกาศนิติกรรม

๒.เพื่อกำหนดลงโทษ หรือประกาศโทษที่เนื่องมาจากความผิด

วรรค ๒ อย่างไรก็ดี การโต้แย้งที่เกิดจากการใช้อำนาจบริหาร สามารถนำสู่การพิจารณาของผู้ใหญ่ หรือศาลปกครองเท่านั้น

มาตรา ๑๔๐๑ โดยสิทธิของตน และของตนเท่านั้น พระศาสนจักรพิจารณา:

๑.คดีที่เกี่ยวกับเรื่องฝ่ายวิญญาณหรือเกี่ยวโยงกับฝ่ายวิญญาณ;

๒.การละเมิดต่อกฎหมายพระ  ศาสนจักร และในทุกกรณีที่มีเรื่องเกี่ยวกับบาปในส่วนที่เกี่ยวกับการกำหนดความผิด และกำหนดการลงโทษทางพระศาสนจักร

มาตรา ๑๔๐๒ โดยคงไว้ซึ่งกฎเกณฑ์ของศาลต่างๆ ของสันตะสำนัก ศาลทั้งหลายของพระศาสนจักร อยู่ภายใต้กฎหมายพระศาสนจักรที่ตามมา

มาตรา ๑๔๐๓ วรรค ๑ กรณีต่างๆ เกี่ยวกับการแต่งตั้งผู้รับใช้พระเจ้าในทำเนียบนักบุญ อยู่ภายใต้กฎหมายเฉพาะของ  สันตะสำนัก

วรรค ๒ อย่างไรก็ดี ให้ใช้ประมวลกฎหมายนี้ สำหรับกรณีต่างๆ ดังกล่าวด้วย เมื่อใดก็ตามที่กฎหมายเฉพาะของ สันตะสำนัก กำหนดให้ใช้กฎหมายสากลในประเด็นใดประเด็นหนึ่ง หรือเมื่อเกี่ยวกับกฎเกณฑ์ที่ใช้กับกรณีต่างๆ ดังกล่าว จากธรรมชาติของเรื่องเองด้วย
